projects. Fire apparatus, manpower and other facilities <br />necessary shall be those identified as required to maintain <br />existing levels of fire service in the above-mentioned study <br />and as deemed necessary by the City Manager. Developer <br />agrees to participate in the funding of such apparatus, <br />manpower and other facilities in whichever manner best <br />achieves the maintenance of existing levels of fire service <br />through timely additions of fire safety equipment, facilities <br />and personnel, as determined by City. In determining the <br />level of participation of such funding agreed to herein, <br /> <br />City shall take into consideration the project's contribution <br />towards fire services in its ordinary contribution towards <br />funding city services, generally (via taxes, etc.) and the <br />level of fire protection designed into subject project. <br /> <br />VI. DEVELOPER'S RImITS <br /> <br /> With reference to each of the agreements contained <br /> <br />herein to place subject site into one or more assessment <br />districts, benefit districts, or other district or funding <br />mechanism requiring approval of all or a majority of properties <br />so included, the developer agrees to either (1) not protest <br />the establishment of the district or (2) to affirmatively <br />vote for the creation of the district or other mechanism, <br />depending on the manner of creation of the funding mechanism. <br />HoWever, Developer retains the right to protest that the <br />allocation of costs among various properties is inequitable <br />under any of the above-mentioned funding mechanisms. <br /> <br /> In the event the assessment mechanism appears to impose <br />economically infeasible levels of cost upon the project <br /> <br />-5- <br /> <br /> <br />
