Box 520 <br />Pleasanton, CA 94566 <br /> <br /> DRAFT <br />AGREEMENT <br /> <br /> THIS AGREEMENT, made and entered into on the ~ day <br /> <br />of , 1982, by and between Mc}~HON-OLIPI~NT DEVELOPmeNT <br /> <br />COEPANY of 501 Parkcenter Drive, Santa Ana, CaliE0rnia 92075 <br />(hereinafter referred to as "Developer") and the CITY OF <br />PLEASANTON, a municipal corporation, 200 Bernal Avenue, Pleasanton, <br /> <br />California (hereinafter referred to as "City"). The City and <br /> <br />Developer agree as set forth below. <br /> WITNESSETH: <br /> <br /> WHEREAS, Developer is the owner of real property in the <br /> <br /> City of Pleasanton described in Exhibit "A", attached to this <br /> agreement and made a part of it by reference, which consists <br /> of 2.38 acres located on the east side of Foothill Road <br /> immediately south of Canyon Way (hereinafter referred to as <br /> the "project site"); and <br /> <br /> ~IEREAS, Developer has received approval for a two-story, <br /> 43,500 sq. ft. office building to be constructed on the <br /> above project site (hereinafter referred to as the "subject <br /> project"); and <br /> <br /> I'alEREAS, prior to approving the project, City adopted a <br />Mitigated Negative Declaration in which certain measures <br />were mutually agreed upon by City and Developer so as to <br />avoid potential significant adverse impacts; and <br /> <br />-1- <br /> <br /> <br />
