CITY COUNCIL OF THE CITY OF PLEASANTON ALA~IDA COUNTY, CALIFORNIA P~SOLUTION NO. 82-178 RESOLUTION APPROVING MITIGATION ~ASUP~S AGREE~INT WITH McMAHON/OLIPHANT DEVELOPb~NT COMPANY WHEREAS, in approving the development plan for an office building to be constructed on 2.38 acres located on the east side of Foothill Road immediately south of Canyon Way, certain conditions were required to be adopted as part of the project approval, including conditions which require the developer/ landowner to enter into an agreement with the City to provide certain water, traffic and fire service facilities and improvements; and WHEREAS, the agreement containing the above-referenced mitigation measures is required to be entered into prior to the issuance of building permits for development of the site; and WtlEREAS , the City and developer/landowner have reached agreement concerning the terms and conditions of an agreement which fulfills the requirements of the conditions of approval; and WtlEREAS, it is in the best interests of the City and developer/landowner to enter into this agreement; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON P~SOLVES AS FOLLOWS: Section 1: Approves the Mitigation Measures Agreement between the City of Pleasanton and McMahon/Oliphant Development Company, a copy of which is attached hereto. Section 2: Authorizes the mayor to execute the agreement. Section 3: This resolution shall become effective irm~ediately upon its passage and adoption.
