CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALA~IDA COUNTY, CALIFORNIA <br /> <br />P~SOLUTION NO. 82-178 <br /> <br />RESOLUTION APPROVING MITIGATION ~ASUP~S <br />AGREE~INT WITH McMAHON/OLIPHANT DEVELOPb~NT <br />COMPANY <br /> <br />WHEREAS, <br /> <br />in approving the development plan for an office <br />building to be constructed on 2.38 acres located on <br />the east side of Foothill Road immediately south <br />of Canyon Way, certain conditions were required to <br />be adopted as part of the project approval, <br />including conditions which require the developer/ <br />landowner to enter into an agreement with the City <br />to provide certain water, traffic and fire service <br />facilities and improvements; and <br /> <br />WHEREAS, <br /> <br />the agreement containing the above-referenced <br />mitigation measures is required to be entered into <br />prior to the issuance of building permits for <br />development of the site; and <br /> <br />WtlEREAS , <br /> <br />the City and developer/landowner have reached <br />agreement concerning the terms and conditions of <br />an agreement which fulfills the requirements of <br />the conditions of approval; and <br /> <br />WtlEREAS, it is in the best interests of the City and <br /> developer/landowner to enter into this agreement; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />P~SOLVES AS FOLLOWS: <br /> <br />Section 1: Approves the Mitigation Measures Agreement <br /> between the City of Pleasanton and McMahon/Oliphant <br /> Development Company, a copy of which is attached <br /> hereto. <br /> <br />Section 2: Authorizes the mayor to execute the agreement. <br /> <br />Section 3: This resolution shall become effective irm~ediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED ~AY 25, 1982 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers - <br /> Mayor Butler <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br /> <br />Brandes, Mercer, Mohr, Wood and <br /> <br /> ROBE~LER,~ <br /> <br /> <br />
