~tEREAS, ~RIEREAS, W]IEREAS, WttEREAS, ~REAS, CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 82-165 RESOLUTION APPROVING APPEAL OF WANDA ALDRICH TO A DECISION OF THE BOARD OF ADJUSTmeNT at its meeting of April 14, 1982, the Board of Adjustment approved case V-82-7, which granted a variance from the off-street parking requirements subject to three conditions; and within the time specified by the Ordinance Code of the City of Pleasanton, the applicant, Wanda Aldrich, submitted an appeal to condition number 2 of the Board of Adjustment approval, to the City Clerk of the City of Pleasanton; and at its meeting of May 25, 1982, the City Council reviewed a report dated May 17, 1982 from the Director of Planning and Community Development together with copies of staff reports to the Board of Adjustment regarding this matter; and the City Council held a public hearing at which time applicant and any other member of the public was offered an opportunity to present evidence regarding this appeal; and after a review of the material presented, the City Council makes the following findings: That because there are special circumstances having to do with the efficient utilization of the subject property, the strict application of the provisions of the Code would deprive the property owner of privileges enjoyed by other properties in the vicinity and under identical zoning classification. That because of the special circumstances mentioned in paragraph (a) above, the granting of the variance will not constitute a grant of special privilege inconsistent with the limitation on other properties classified in the same zoning district. That the granting of the variance will not be detrimental to the public health, safety, or welfare, or materially injurious to properties or improvements in the vicinity.
