That the developer shall submit evidence <br />satisfactory to this City Council that the costs proposed to <br />be assessed shall have been actually incurred and paid, and <br />that the land proposed to be assessed shall be free of <br />mechanics' liens resulting from the construction of the im- <br />provements. <br /> <br /> This resolution shall in no way constitute a <br />guarantee or assurance that the special assessment proceedings <br />will be completed, the City Council being without jurisdiction <br />to assure the levy of special assessments until conducting a <br />public hearing as required by the Municipal Improvement Act <br />of 1913. <br /> <br /> I HEREBY CERTIFY that the foregoing resolution was <br />duly and regularly adopted by the City Council of the City of <br />Pleasanton, Alameda County, California, at a regular meeting <br />thereof, held on the 13th day of July, 1982. <br /> <br />AYES: <br /> <br />NOES: <br /> <br />ABSENT: <br /> <br />Councilmembers Brandes, Mercer, Mohr, Wood, and Mayor Butler <br />Councilmembers None <br /> <br />Councilmembers None <br /> <br />JAMES R.
