WltEF~AS, prio_ to approving the General _ lan amendment, <br /> City adopted a l~itigated l~egative Declaration in ~hich <br /> certain measures were mutually agreed npon by City and <br /> Developer so as to .avoid potential significant adverse <br /> impacts; and <br /> <br /> ~EREAS, mitigating measures included (1) financial <br />participation by Developer in certain.studies and (2),agree- <br />ment to participate in assessment districts br other funding <br />mechanisms for certain improvements; and : <br /> <br /> I~EREAS, the studies required are currently'undebyay, <br /> <br />as is preliminary ~ork on various assessment districts <br />designed to implement the mitigation measures, but the final <br />cost and method of allocating the cost among several projects <br />has not yet been determined, it being the City's desire to <br />spread the total cost of the studies fairly among partici- <br />pating projects; and <br /> <br /> ~a!Et~AS, Developer desires to secure subdivision'approval <br />and,building permits for the project as soon as possible, <br />prior to the completion of,-~nd determination of the financing <br />of, the jtudies and improvements required; and <br /> <br /> I~IEP~AS, certain conditions of approval of the PUD <br />require Developer and City, prior to approval of a subdivision <br />nrap, tO enter agreement concerning certain noise mitigation <br />measures to be made in the future and concerning certain <br />safeguards for City; and <br /> <br /> ~IEREAS, City may adequately protect its interest in <br />securing payment for the various studies and improV~nents <br /> <br />-2- <br /> <br /> <br />
