Box 520 <br />Pleasanton, CA 94566 <br /> <br />AGREEMENT <br /> <br /> THIS AGREEMENT, made and entered into on the <br /> <br />day of , 1982, by and between CALLAHAN- <br /> <br />PENTZ PROPERTIES, PLEASANTON, a California general <br />partnership (hereinafter referred to as "Developer") <br />and the CITY OF PLEASANTON, a municipal corporation, <br /> <br /> (hereinafter referred to as "City"). The City and <br /> <br />Developer agree as set forth below. <br /> WITNESSETH: <br /> <br /> WHEREAS, Developer is the owner of real property <br />in the City of Pleasanton described in Exhibit "A", <br />attached to this agreement and made a part of it by <br />reference, which consists of Lots 3, 4, 16, 17, 18, 28, <br />34 and 37, as shown on Parcel Map 3858 (hereinafter <br />referred to as the "project site"); and <br /> <br /> WHEREAS, Developer has received approval for a <br />general plan amendment, Resolution No. 81-186, and PUD <br />rezoning and development plan approval, Ordinance No. <br />1040, which would allow a proposed business park to be <br />developed on the above project site in conjunction with <br />adjacent properties owned by The Prudential Insurance <br />Company of America, together forming the 573 acre <br />Hacienda Business Park (hereinafter referred to as the <br />"project"); and <br /> <br />-1- <br /> <br /> <br />
