D. City will incur other out-of-pocket costs in preliminary <br /> studies, plan review by other agencies, and other activities re- <br /> lating to the creation of the assessment district. <br /> <br /> E. City is unable to provide the financing for the preliminary <br />.costs which will be incurred purusant to the Mark Thomas and Company <br />agreement and other activities prior to the formation of the assess- <br />ment aistrict. <br /> <br /> F. Prudential, as one of the developers of Hacienda Business <br /> Park, will be a major beneficiary of the roadway improvements <br /> contemplated by the North Pleasanton Improvement Distriet and is <br /> willing to finance the costs of engineering services and other <br /> expenses neeessary prior to formation of the assessment distriet <br /> <br />and sale of bonds in an amount not to <br />Thousand Dollars ($350,000.00). <br /> <br /> G. It is in the public interest <br /> <br />exceed Three Hundred Fifty <br /> <br />that the proposed assessment <br /> <br />district proceed in order to provide necessary roadway improvements <br />in a timely fashion as well as to allow the Hacienda Business Park <br />to be developed as the well-designed and properly planned project <br />contemplated. Prudential and City have reached agreement concerning <br />Prudential's share of the financing of the costs of engineering <br />services prior to the formation of the assessment district and <br />sale of bonds and now desire to set forth their mutual understanding <br /> <br />and agreement pertaining <br /> <br /> PRUDENTIAL AND CITY, <br />AS FOLLOWS: <br /> <br />thereto-in writing. <br /> <br /> IN CONSIDERATION ~OF THE ABOVE, AGREE <br /> <br />-2- <br /> <br /> <br />
