D. City will incur other out-of-pocket costs in preliminary studies, plan review by other agencies, and other activities re- lating to the creation of the assessment district. E. City is unable to provide the financing for the preliminary .costs which will be incurred purusant to the Mark Thomas and Company agreement and other activities prior to the formation of the assess- ment aistrict. F. Prudential, as one of the developers of Hacienda Business Park, will be a major beneficiary of the roadway improvements contemplated by the North Pleasanton Improvement Distriet and is willing to finance the costs of engineering services and other expenses neeessary prior to formation of the assessment distriet and sale of bonds in an amount not to Thousand Dollars ($350,000.00). G. It is in the public interest exceed Three Hundred Fifty that the proposed assessment district proceed in order to provide necessary roadway improvements in a timely fashion as well as to allow the Hacienda Business Park to be developed as the well-designed and properly planned project contemplated. Prudential and City have reached agreement concerning Prudential's share of the financing of the costs of engineering services prior to the formation of the assessment district and sale of bonds and now desire to set forth their mutual understanding and agreement pertaining PRUDENTIAL AND CITY, AS FOLLOWS: thereto-in writing.
