AGREEMENT <br /> <br /> THIS AGREEMENT is made and entered into this day of <br /> <br /> , 1982, by and between THE PRUDENTIAL INSURANCE COMPANY <br /> OF A~ERICA, a New Jersey corporation (hereinafter referred to as <br /> "Prudential"), and THE CITY OF PLEASANTON, a municipal corporation <br /> (hereinafter referred to as "City"). <br /> <br /> RECITALS <br /> <br /> A. Due to significant proposed industrial/commercial growth <br />requiring major roadway improvements in the North Pleasanton area, <br />City has begun formal assessment district proceedings for a pro- <br />posed roadway improvements program entitled "NorthPleasanton <br />Improvement District, Project AD 198264,'' including within the <br />proposed boundaries lands of Prudential proposed for industrial <br />park development. <br /> <br /> B. The size of the proposed assessment district is such <br />that significant engineering and other costs, reimbursable by <br />the assessment district if and when formed, will be required <br />prior to the formation of the assessment district and the sale <br />of bonds. <br /> <br /> C. City has contracted with Mark Thomas and Company, Inc., <br />consulting civil engineers and municipal planners, to provide <br />the engineering services in connection with the proposed roadway <br />improvement program, said agreement calling for periodic progress <br />payments as work progresses. <br /> <br />-1- <br /> <br /> <br />
