"F. Since RAP Approvals for the units to which the 37 Permits pertained were not issued until November 28, 1978, the three-year deadline for obtaining building permits on such units did not start to run until November 28, 1978 with the result that such deadline would expire on Novem- ber 28, 1981. The three-year deadline on the 9 Permits would expire on January 16, 1982. As a result of the 1972 Court Order, the three-year deadline on the 18 Permits and the 21 Permits (hereinafter collectively referred to as the "39 Permits") commenced running on April 6, 1981 and will expire on April 6, 1984." 3. Section 1 of the Agreement is amended in its entirety to read as follows: "1. No building permits will be issued on the Property prior to September 8, 1983." 4. Section 2 of the Agreement is amended in its entirety to read as follows: "2. The effect of the Agreement was to extend until November 28, 1982, January 16, 1983, and April 6, 1985 the time within which building permits could be obtained for the Property by Stoneson with- out the expiration of all or any portion of the 37 Permits and/or the 9 Permits and/or 39 Permits, respectively. The effect of the Amendment is to extend until November 28, 1983, January 16, 1984, and April 6, 1986, the time within which building permits can be obtained for the Property by Stoneson without the expiration of all or any portion of the 37 Permits and/or the 9 Permits and/or 39 Permits, respectively." 5. The following provisions shall be incorporated as Section 4 of the Agreement and shall be made a part thereof: "4. Nothing in this Agreement shall be construed tO effect, or to require Pleasanton to grant, ex- tensions of the RAP Approvals granted with respect to the Property, which RAP Approvals (as stated in Recital F) shall expire on May 24, 1983 (39 RAP Approvals) and May 28, 1983 (46 RAP Approvals.)" -3-
