(i) the Sewer Permits (as defined in the Agreement) and (ii) the Residential Allocation Program approvals ("RAP Approvals") granted by Pleasanton with respect to the Property. NOW THEREFORE, in consideration of the mutual pro- visions in the sum of One Thousand Dollars ($1,000) being paid to Pleasanton as a processing fee concurrently herewith, the parties agree to amend the Agreement as follows. 1. Recital B of the Agreement is amended in its entirety to read as follows: "B. Stoneson has purchased and now has out- standing eighty-five (85) D.U.E. (Dwelling Unit Equivalent) sewer-system connection permits ("Sewer Permits") for use in development of the Property, such permits having been issued by the Dublin-San Ramon Services District ("DSRSD") pursuant to Alameda County Superior Court Orders in Civil Action No. 423134 filed December 19, 1972 and April 22, 1980 (the "Court Orders"). Thirty- seven (37) of the Sewer Permits ("37 Permits"), bearing Permit NO. P-104, were issued to Stoneson on September 13, 1978; nine (9) of the Sewer Permits ("9 Permits"), bearing Permit No. P-112, were issued to Stoneson on January 16, 1979; eighteen (18) of the Sewer Permits ("18 Permits") were issued to Stoneson by the City of Pleasanton on July 3, 1980; and twenty-one (21) of the Sewer Permits ("21 Permits") were issued to Stoneson by the City of Pleasanton on November 24, 1980 (the 21 Permits erroneously were authorized to Tract 2896 which error was corrected in an amendment to the applicable sewer connection permit, such amendment dated as of March 1981) j Pleasanton granted RAP Approvals for 72 units on November 28, 1978, for 29 units on June 5, 1978 and for 39 units on November 24, 1980. RAP Approvals will expire on May 24, 1983 for thirty nine (39) units and on May 28, 1983 for forty six (46) units on the Property." 2.
