DEVELOPMENT DEFERMENT AGREEMENT <br /> <br /> THIS DEVELOPMENT DEFERMENT AGREEMENT (the "Agreement") <br /> <br />is made this day of August, 1982, by and between THE <br /> <br />STONESON DEVELOPMENT CORPORATION, a California corporation <br />("Stoneson"), and the CITY OF PLEASANTON, a municipal corpor- <br />ation ("Pleasanton") . <br /> <br /> RECITALS <br /> <br /> A. Stoneson is the owner in fee of certain un- <br />improved real property located in Pleasanton, California, <br />designated as certain lots of Parcel B, Parcel Map 400. <br /> <br /> B. Stoneson has purchased and now has outstanding <br />one hundred seventy six (176) D.U.E. (Dwelling Unit Equivalent) <br />sewer-system connection permits ("Sewer Permits") for use in <br />development of the Property, such Sewer Permits having been <br />issued by the Dublin-San Ramon Services District ("DSRSD") <br />pursuant to Alameda County Superior Court Orders in Civil Action <br />NO. 423134, filed December 19, 1972 and April 22, 1980 (the <br />"Court Orders"). Sixty-five (65) of the Sewer Permits ("65 <br />Permits") bearing Permit No. 115, were issued to Stoneson on <br />July 16, 1979. Sixty-nine (69) of the Sewer Permits ("69 <br />Permits") were issued to Stoneson in July 1980 and forty-two <br /> <br />(42) of the Sewer Permits <br />in November 1980. <br /> <br /> C. For purposes <br />capacity pursuant to <br /> <br />("42 Permits") were issued to Stoneson <br /> <br /> of allocating sewer-connection <br />the 1972 Court Order, Stoneson and <br /> <br /> <br />
