CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 82-329 A RESOLUTION OF NECESSITY TO ACQUIRE BY EMINENT DO[~IN PROPERTY NEEDED FOR THE REALIGNmeNT OF JOHNSON DRIVE WEST OF HOPYARD ROAD WHEREAS, in analyzing the traffic circulation system necessary to accommodate the planned development in the North Pleasanton area, the City of Pleasanton focussed special attention on the configuration of the Johnson Drive-Hopyard Road intersection which, due to its inadequate design, has caused existing congestion and confusion; and WtlEREAS, alternative plans were presented to alleviate the existing congestion and confusion on the western leg of the intersection which would also best accommodate the planned growth in traffic due to development of the area, and a realignment plan was approved by the Planning Commission and City Council; and WHEREAS, implementation of the realignment plan for Johnson Drive west of Hopyard Road requires acquisition of private property; and ~tEREAS, a detailed plan for exchanges of land between the City and affected property owners as well as for replacement improvements to be provided to properties affected has been prepared which will allow the street system improvement to be constructed with minimal impact upon existing uses; and WHEREAS, notice was given pursuant to Section 1245.235 of the Code of Civil Procedure of the State of California and a hearing was held at which time persons affected had an opportunity to appear and be heard; NOW, TtIEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The City Council finds that, pursuant to Section 37350.5 of the Government Code of the State of California authorizing the City of Pleasanton to acquire property by eminent domain, all that land described in Exhibit A, attached hereto and including portions of Assessor's Parcels 941-1301-10, 941- 1301-13-5, 941-1301-11 and 941-1302-2, is necessary for public use as a public street.
