CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-329 <br /> <br />A RESOLUTION OF NECESSITY TO ACQUIRE BY EMINENT <br />DO[~IN PROPERTY NEEDED FOR THE REALIGNmeNT OF <br />JOHNSON DRIVE WEST OF HOPYARD ROAD <br /> <br />WHEREAS, <br /> <br />in analyzing the traffic circulation system necessary <br />to accommodate the planned development in the <br />North Pleasanton area, the City of Pleasanton <br />focussed special attention on the configuration of <br />the Johnson Drive-Hopyard Road intersection which, <br />due to its inadequate design, has caused existing <br />congestion and confusion; and <br /> <br />WtlEREAS, <br /> <br />alternative plans were presented to alleviate the <br />existing congestion and confusion on the western <br />leg of the intersection which would also best <br />accommodate the planned growth in traffic due to <br />development of the area, and a realignment plan <br />was approved by the Planning Commission and City <br />Council; and <br /> <br />WHEREAS, <br /> <br />implementation of the realignment plan for Johnson <br />Drive west of Hopyard Road requires acquisition of <br />private property; and <br /> <br />~tEREAS, <br /> <br />a detailed plan for exchanges of land between the <br />City and affected property owners as well as for <br />replacement improvements to be provided to properties <br />affected has been prepared which will allow the <br />street system improvement to be constructed with <br />minimal impact upon existing uses; and <br /> <br />WHEREAS, <br /> <br />notice was given pursuant to Section 1245.235 of <br />the Code of Civil Procedure of the State of California <br />and a hearing was held at which time persons <br />affected had an opportunity to appear and be <br />heard; <br /> <br />NOW, TtIEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section <br /> <br />1: The City Council finds that, pursuant to Section <br /> 37350.5 of the Government Code of the State of <br /> California authorizing the City of Pleasanton to <br /> acquire property by eminent domain, all that land <br /> described in Exhibit A, attached hereto and including <br /> portions of Assessor's Parcels 941-1301-10, 941- <br /> 1301-13-5, 941-1301-11 and 941-1302-2, is necessary <br /> for public use as a public street. <br /> <br /> <br />
