the Harris Professional Center, <br /> <br />Chevron service <br /> <br /> station, and Denny's restaurant, as shown on the <br /> <br /> Realignment Plan, in order to off-set the costs of <br /> <br /> m <br /> the property acquisition required for the tea 'gnent <br /> <br /> ~lan as well as to maintain existing uses as <br /> <br /> viable enterprises. <br /> <br /> 4.5. City agrees to allow the Pleasanton Park Owners' <br /> Association to maintain, at no cost to City, the <br /> landscaping to be installed within the Owens Drive <br /> right-of-way from Hopyard Road to the realigned <br /> Johnson Drive. City further agrees to use its <br /> best efforts to have the owners and/or lessees of <br /> the parcels occupied by the Chevron service station, <br /> Harris Professional Center, and Denny's and <br /> Hungry Hunter restaurants (i) agree to allow their <br /> existing landscaping which will not be affected by <br /> the street realignment and replacement improvements <br /> to be upgraded and (ii) ~e allow all of their <br /> landscaping - that upgraded together with the <br /> replacement landscaping to be provided - to be <br /> maintained by the Pleasanton Park q~ers' <br /> Association, the reasonable and actual cost of <br /> said maintenance to become a charge against the <br /> parcel owners and/or lessees. <br /> <br />Obligations of All Parties <br /> <br /> 5.1. City, R & B, Prudential and CP agree to cooperate <br /> to effect the formation of the NPAD as soon as <br /> <br />reasonably practical. <br /> <br />-8- <br /> <br /> <br />
