2.2 Notwithstanding the provisions of Para- <br />graph 2.1, Developer retains the right to protest the reason- <br />ableness and equity of the City'sdetermination of the Fire <br />Safety Services Requirements, the cost of the Fire Safety <br />Services Requirements, and the apportionment of the costs of <br />the Fire Safety Services Requirements to the Property. <br /> <br /> 3. Project Conditions. Nothing herein shall <br />lessen any obligation imposed upon Develgper or the Property <br />as a condition of approval of the Project by the City. <br /> <br /> 4. Default. In the event of any default or <br />breach of this agreement by either party, Such party (or <br />successor) shall, upon written notice from the other, pro- <br />ceed immediately to cure or remedy such default or breach. <br />In the event such default or breach is not cured or remedied <br />within sixty (60) days after receipt of such notice, or, if <br />such breach or default cannot be reasonably cured or <br />remedied within sixty (60) days, the party in default or <br />breach has not within said sixty (60) days commenced to cure <br />or remedy such default or breach in a diligent manner, the <br />aggrieved party may institute such proceedings as may be <br />necessary or desirable in its opinion to cure and remedy <br />such default or breach, including, but not limited to, <br />proceedings to compel specific performance by the party in <br />default or breach of its obligations, <br /> <br />-5- <br /> <br /> <br />
