Section 2: For a project not meeting the requirements <br /> above, RAP development approval shall not lapse if <br /> said project has made good faith progress as <br /> defined herein prior to the date the project's <br /> development approval is scheduled to lapse. Good <br /> faith progress shall require the following: <br /> <br />filing with the City Council a final map <br />encompassing the entire project subject to <br />the RAP development approval; <br /> <br />execution of a subdivision agreement containing <br />the following: <br /> <br />a one year time period for construction <br />of all public improvements within the <br />project; <br /> <br />b. a "time is of the essence" clause; and <br /> <br />an express waiver of the security provider's <br />ability to escape from the City's use of <br />the security to undertake to construct <br />the public improvements secured if <br />construction of the public improvements <br />has not commenced within the one year <br />time period; and <br /> <br />payment of the total contributions to the <br />City's "Housing Fund" and "Capital Improvement <br />Fund" offerred as part of the project's RAP <br />application (total units in project multiplied <br />by contributions offerred per unit) prior to <br />the scheduled date of lapse of RAP development <br />approval. <br /> <br />Section <br /> <br />3: This resolution shall supersede all or any <br /> portion of all prior resolutions establishing City <br /> policy with respect to the lapsing of RAP development <br /> approvals to the extent all or any portion of said <br /> prior resolutions are in conflict herewith. <br /> <br />Section 4: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED SEPTEMBER 14, 1982 BY THE FOLLOWING <br />VOTE <br /> <br />AYES Councilmembers Brandes, ~ercer, Mohr, Wood and <br /> Mayor Butler <br />NOES None <br />ABSENT: None <br />ABSTAIN: None ~/~ <br />ATTEST: <br /> <br /> Peter D. ~acDona~d, City Attorney <br /> <br /> <br />
