Section 2: For a project not meeting the requirements above, RAP development approval shall not lapse if said project has made good faith progress as defined herein prior to the date the project's development approval is scheduled to lapse. Good faith progress shall require the following: filing with the City Council a final map encompassing the entire project subject to the RAP development approval; execution of a subdivision agreement containing the following: a one year time period for construction of all public improvements within the project; b. a "time is of the essence" clause; and an express waiver of the security provider's ability to escape from the City's use of the security to undertake to construct the public improvements secured if construction of the public improvements has not commenced within the one year time period; and payment of the total contributions to the City's "Housing Fund" and "Capital Improvement Fund" offerred as part of the project's RAP application (total units in project multiplied by contributions offerred per unit) prior to the scheduled date of lapse of RAP development approval. Section 3: This resolution shall supersede all or any portion of all prior resolutions establishing City policy with respect to the lapsing of RAP development approvals to the extent all or any portion of said prior resolutions are in conflict herewith. Section 4: This resolution shall become effective immediately upon its passage and adoption.
