CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-367 <br /> <br />A RESOLUTION ADOPTING A POLICY FOR THE IMPLEMENTATION <br />OF THE DEVELOPMENT APPROVAL LAPSING PROVISIONS OF <br />THE RESIDENTIAL ALLOCATION PROGRAM (RAP) <br /> <br />WHEREAS, <br /> <br />many projects which have received development <br />approval under the provisions of the RAP ordinance <br />have not proceeded far enough, as yet, with their <br />development projects to avoid the lapsing of <br />development approval in mid-1983, due primarily to <br />the economic conditions existing over the last <br />several years which have contributed to the nation- <br />wide slump in new housing construction; and <br /> <br />WHEREAS, <br /> <br />recognizing past economic conditions, the City <br />Council wishes to adopt a uniform, unambiguous <br />policy with respect to the lapsing of RAP development <br />approval which is (i) capable of being met by <br />developers both still wanting to develop and <br />having made good faith ascertainable progress <br />toward complete development, and (ii) meets the <br />goals of the City in achieving timely growth; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> Projects meeting the requirements of Section 2- <br />20.14 of Ordinance No. 849, as it existed at the <br />time the project received RAP development approval, <br />shall not have their RAP development approval <br />lapse. These require the following: <br /> <br />for projects receiving a single approval: <br />commencement of construction on at least one <br />building within the project; and <br /> <br />for projects which received several separate <br />approvals or a single, phased approval: <br /> <br />for the first approval or phase: commencement <br />of construction on at least one building <br />within the approved portion of the <br />project. <br /> <br />for all subsequent approvals or phases: <br />commencement of construction on all <br />units in prior approvals or phases plus <br />commencement of construction on at least <br />one unit within the subsequent approval <br />or phase. <br /> <br /> <br />
