Failure to meet time requirements shall <br />permit City to terminate this Agreement immediately. <br />City may extend time periods at its discretion. <br /> <br />PROPERTY OF CITY <br />Owner agrees that all studies, reports, design materials, <br />plans and specifications for the expansion of the Dublin <br />San Ramon Services District Treatment Plant and LAVW~4A <br />Export Pipeline and related facilities undertaken, com- <br />pleted and paid for by ~ner shall become the property <br />of City and other governmental agencies designated by <br />City.. <br /> <br />FEASIB'~LITY STUDY, PAYMENT <br />Owner agrees to pay City $6,000 for the cost of an <br />engineering feasibility study by REM Consulting Engineers <br />relating to DSRSD study for expansion of plant. Such <br />payment to be made within ten (10) days after the signing <br />of this Agreement by Owner and City. <br /> <br />DEVELOPMENT/~STER PLAN <br />Owner shall, prior to the date selected by City <br />for the election if required by LA~MA or prior to <br />solicitation of construction bids if no election is <br />held, provide City with a proposed general comprehensive <br />master plan for the development of Owner's property. <br />Such comprehensive master plan will designate approxi- <br />mate locations for streets and the proposed uses for all <br />sites. Such comprehensive master plan will also <br />indicate development phasing. <br /> <br />DEPOSITS <br />O~.mer shall deposit with City within twenty-five (25) <br />days after bid opening for construction of the expansion <br />project cash, surety bonds, certificates of deposit, or <br />other securities acceptable to the City equal to the <br />lowest acceptable construction bid plus contingencies and <br />administrative costs as determined by City. Thirty (30) <br />days after the acceptance by City of the "Engineer's <br />Estimate" of the cost of the entire project either party <br />may terminate this Agreement without cost or obligation. <br />At the completion, acceptance, and payment of obligations <br />and liens of the construction projects any unencumbered <br />funds, bonds, certificates of deposits, or other <br />securities of Owner remaining with City shall be <br />returned to 0~er. Upon commencement of construction of <br />any portion of Stoneridge Drive on Owner's property <br />as described in Exhibit A Owner shall pay to the City <br />the amount required by the City to finance (or reimburse) <br />one-half (1/2) of the cost of traffic signals at the <br />intersection of Stoneridge Drive and Hopyard Road. <br /> <br /> <br />
