Page 12 of 15 <br /> <br />pay any attorneys' fees or court costs to enforce this <br />Agreement, the party in breach agrees to reimburse the <br />other party for such expenses, fees, or costs within <br />thirty (30) days after receiving written notice of same <br />from said party; <br /> <br /> E. This Agreement may be further amended only by <br />written agreement between the parties hereto. Failure <br />on the part of either party to enforce any provisions <br />of this Agreement shall not be construed as a waiver of <br />the right to compel enforcement of such provision or <br />provisions, nor act to release the other party from its <br />obligations under this Agreement; <br /> <br /> F. Owner shall assign its rights, obligations, and <br />interest in this Agreement to The Prudential Insurance <br />Company of America, Proposed Assignee, upon said PrOposed <br />Assignee's taking title to the property described in <br />Exhibit "A", attached hereto. Owner shall provide City <br />written notice of said assignment. City hereby consents <br />to said assignment. Said Proposed Assignee may not assign <br />its rights, interests, and obligations in this Agreement <br />without the prior written consent of City; <br /> <br /> G. The terms of this Agreement shall be for a period <br />of fifteen (15) years commencing on the date of execution <br />by the parties hereto unless otherwise terminated as <br />provided herein; <br /> <br /> H. If Owner, or 0wner's Proposed Assignee, defaults <br />on any obligations of Owner, or Owner's Proposed Assignee, <br />created by this Agreement or is in breach of any of <br /> <br />Owner's, or Owner's Proposed Assignee's, covenants contained <br /> <br /> -12- <br /> <br /> <br />
