City and Owner, in consideration <br />of the mutual covenants, conditions, rights and obligations <br />provided for herein agree as follows: <br /> <br /> A. The parties hereto acknowledge that the City's <br /> obligations to Owner as lead agency for the LAV~,~ and <br /> DSRSD expansions and for the discrete sewer plant described <br /> herein, require the cooperation, agreement, and approval <br /> of other governmental agencies not under the control of the <br /> City. Both parties hereto agree to cooperate with the <br /> other to obtain said approvals, provided, however, that <br /> City's obligations hereunder are premises of good faith <br /> effort by City that do not represent guarantees regarding <br /> the obtaining of said approvals; <br /> <br /> B. Owner agrees that all studies, reports, design <br /> materials, plans and specifications, and environmental <br /> studies undertaken by Owner, at Owner's sole cost and <br /> expense, to facilitate the iAV~A and DSRSD expansion <br /> shall become the property of City and other governmental <br /> agencies designated by City; <br /> <br /> Co Owner acknowledges that the terms and conditions <br /> contained in this Agreement do not grant or convey <br /> title or interest to Owner to any improvements, or public <br /> facilities which may be constructed for LAVI~A or DSRSD <br /> with funds derived from O~ner; <br /> <br /> Do In the event either O~ner or City breach this <br /> Agreement and the other is forced to incur any expenses, <br /> <br />-11- <br /> <br /> <br />
