the Livermore-Amador Valley Water Management Agency export pipeline. <br /> (Said agreement is attached hereto and incorporated by reference <br /> herein and designated as Exhibit "A") The use of the capacity is <br /> limited to industrial (including non-retail commercial) uses. <br /> <br /> E. The City has elected to allocate the above-described <br /> <br />500,000 GPD of sewer capacity on the basis of certain criteria <br />contained in a recent policy statement adopted by the City. The <br />Caroline property, the subject of this contract, meets a number <br />of the criteria set forth in the City's policy statement and further <br />Caroline has agreed to provide as a part of his zoning and subdivision <br />approvals landscaped open space within the project area, to widen <br />and improve Valley Avenue including construction and landscaping <br />of a median strip, and has agreed to provide off-tract improvements <br />including an over-sized 72 inch storm drain to drain the surrounding <br />area totaling approximately 140 acres, an over-sized sanitary sewer <br />line designed to drain the surrounding area of approximately 273 <br />acres, the installation of an over-sized 20 inch water line down Valley <br />Avenue, the redesign of the Jensen lift station and improvement of <br />the facilities of that station to enable it to handle the increased <br />sewer flow from the 273 acre area referred to above, and the obtaining <br />of easements from Western Pacific Railroad for sewer line and storm <br />drain, and the purchase of additional property to obtain an easement <br />for the storm drain. <br /> <br />from the <br /> <br />order to <br /> <br />park the City has agreed to <br />of the 500,000 GPD of sewer <br /> <br />The City desires <br />above agreements <br /> <br />insure adequate sewer capacity for the proposed business <br /> allocate 63,000 gallons per day (GPD) <br /> capacity described in paragraph D <br /> <br />to obtain the public benefits resulting <br />of Caroline and in return therefor in <br /> <br />-2- <br /> <br /> <br />
