NEAL STREET <br />PLEASANTON, CALIFORNIA 94566 <br /> <br />April 10, 1980 <br /> <br />City of Pleasanton <br />200 Bernal Avenue <br />Pleasanton, California 94566 <br /> <br />Attention: Harvey Levine,.City Attorney <br /> <br />Dear Harvey: <br /> <br /> Re: City Water Pipeline Easement - Hansen-Mix Property <br /> <br />The City. has requested a conveyance of a non-exclusive temporary <br />easement(by the conveyance of two parcels) over and across the <br />property owned by Hansen and Mix located westerly of the Del <br />Prado development. However, since this project is being funded <br />by the federal government, we have been advised that the "temporary" <br />restriction is prohibited; nevertheless, the conveyance is on the <br />express condition that this easement is temporary in nature and <br />will be reconveyed as hereinafter provided. <br /> <br />I enclose the deed executed by Hansen and Mix conveying the <br />easement over the two parcels in question to the City. I am <br />attaching to this letter a copy of that deed and a copy of a <br />plot plan showing the location of the easement on the two parcels <br />in question. I have also attached copies of the deed and plot <br />plan to a copy of this letter enclosed. <br /> <br />The Hansen-Mix property on which this easement is located will <br />be developed for residential use. Undoubtedly the street shown on <br />the plot plan named Calle Altamira will be extended westerly 'and <br />a water main constructed therein. The Parcel 1 easement upon <br />such development will be located in the eastern sideyard of the <br />most easterly lot located on the south side of Calle Altamira, as <br />extended; the easement on Parcel 2 will be located within the <br />area that we believe the Alameda County Flood Control and Water <br />Conservation District (Zone 7) will require to be dedicated in <br />the e~ent of such development. We have been advised that Zone 7 <br />will not accept such dedication of property subject to a prior <br />existing easement. <br /> <br />The delivery of the enclosed deed to the City and its.acceptance <br />thereof is on the express condition that upon such development <br /> <br />EXHIBIT "A" <br /> <br /> <br />
