water pipeline within a developed street or public service <br />easement constructed by Developer, or successors in interest, <br />which provides an acceptable alternative water source to the <br />existing City water pipeline located on the lands of Alameda <br />County Flood Control and Water Conservation District at the <br />northeast corner of the confluence of the Arroyo del Valle <br />and Arroyo de la Laguna. Abandonment shall be accomplished <br />by conveyance of quitclaim deeds from City to Owner, or <br />successors in interest. <br /> <br /> IV. City shall construct the water pipeline a minimum <br />of three (3) feet below the planned final grade of the area <br />presently being filled and shall coordinate the location and <br />construction of the water pipeline with Developer in order <br />to minimize interference with the planned extension of Calle <br />Altamira and other utilities therein and with the grading <br />operations taking place on the site. City agrees that the <br />portion of the water pipeline lying in the planned extension <br />of Calle Altamira shall be available for Developer's use <br />upon development of the site; however, Developer agrees to <br />reimburse City for the costs of that portion of the water <br />pipeline lying in the extension of Calle Altamira, being <br />approximately 269.35 feet of eight (8) inch A.C.P~ waterline, <br />at the time of development of that portion of Calle Altamira <br />overlying the water pipeline. <br /> <br /> V. City shall indemnify and save harmless Owner and <br />Developer, and successors in interest, from and against all <br />claims, damages, suits, costs, losses and expenses in any <br /> <br />-3- <br /> <br /> <br />
