APPENDIX A TO AGREEMENT <br /> <br />BETWEEN CITY OF PLEASANTON AND THE PACIFIC TELEPHONE <br /> <br /> AND TELEGRAPH COMPANY DATED <br /> <br /> 1. City shall perform its work as an independent <br />contractor and not as the agent, employee or servant of Company and <br />shall comply with all applicable federal, state, county and <br />municipal laws and ordinances and all applicable orders, rules, <br />regulations, conditions and requirements of all properly <br />constituted public authority. <br /> <br /> 2. Company shall not be responsible for any loss or <br /> <br />damage to any work performed by City <br />used by City in performing said work. <br /> <br /> 3. City or its contractor <br />good workmanlike manner and the work <br /> <br />or to any material or supplies <br /> <br />shall perform its work in a <br />shall be free from faulty or <br /> <br />defective workmanship. All materials furnished by City shall be <br />free from defects. City shall immediately, upon notification from <br />Company, remedy, repair or replace without cost to Company and to <br />its entire satisfaction, and to the satisfaction of governmental <br />officials having jurisdiction, all defects, damages or <br />imperfections, caving, sinking, or settling which may appear in <br />said work within a period of two (2) years after the date of final <br />completion. Company shall exercise reasonable diligence to <br />discover and report to City, as work progresses, all unsatisfactory <br />material and workmanship furnished by City so as to avoid <br />unnecessary trouble and cost to City in making them good. <br /> <br />Page 1 of 3 <br /> <br /> <br />
