4. The Johnson Drive realignment must be completed to <br /> allow the Hopyard Road improvements, now under construction, <br /> to be completed, including affording access to the Pleasanton <br /> Park industrial project now under construction, and acquisition <br /> of the right-of~way for the realigned street is urgently <br /> required. Completion of the appraisal according to the terms <br /> of this agreement is necessary in order to meet the construction <br /> timetable required to allow completion of the Hopyard Road' <br /> improvements, including providing access to Pleasanton Park. <br /> <br /> 5. Appraisers and City have reached agreement concerning <br />the content of the appraisal services to be rendered and the <br />consideration therefor and now desire to set forth their <br />respective understandings and agreement pertaining thereto in <br />writing. <br /> <br /> THE CITY AND APPRAISERS AGREE AS SET FORTH BELOW: <br /> <br />I. Scope of Work <br /> <br /> Appraisers agree to prepare an appraisal report adequate <br /> <br />and sufficient to enable City's right-of-way agents to negotiate <br />the acquisition of real property within the proposed right-of-way <br />of the widened Hopyard Road snd the realigned Johnson Drive east <br />of Hopyard Road, as more particularly shown on the plats <br />identified as Exhibit "A", attached hereto and incorporated <br />herein by this reference, and, if necessary, to enable City <br />to acquire immediate possession of the property through eminent <br />domain proceedings.
