2. ABreement to Annex. O~,~er agrees to <br />annex to the City of Pleasanton all those lands <br />herein at such time as City may require. Owner <br /> <br />consent to <br />described <br />and City <br /> <br />facilities <br />boundaries, <br />follows: <br /> <br />agree that the provisions of this agreement, state and <br />county laws, and City ordinances and resolutions shall <br />control the responsibilities of both parties at the time of <br />annexation. ~ner further agrees to cooperate with City in <br />the annexation of the lands described herein, whether alone <br />or as part of a larger area, and expressly waives the right <br />to protest said annexation and agrees to do no act calculated <br />or tending to prevent, impede, or defeat the successful <br />annexation of said property. <br /> <br /> 3. Land Subject to This Agreement. The land subject <br /> <br />to this agreement shall be those lands of Owner more particularly <br />described in the legal description and map attached hereto <br />as Exhibit A and made a part hereof. <br /> <br /> 4. Annexation Fee. When the land of Owner is annexed <br /> <br />to City and in consideration and part payment for City-owned <br /> <br /> located both in and out of the original City <br /> <br /> ~ner shall pay to City an annexation fee as <br /> <br /> ~O HUNDRED DOLLARS ($200.00) for each acre or <br /> portion thereof of 0wner's property as described <br /> in Exhibit A, attached hereto. <br /> <br /> 5. Bonded Debt. Owner does hereby consent that, upon <br />annexation of his property to City, said property shall be <br />taxed to pay its share of existing bonded indebtedness of <br />City.
