7. Subject to the conditions hereinafter provided, PGandE is <br />willing to complete the installation of the Electric Facilities by using <br />all or a portion of the Electric Substructures as shown on Exhibit "A," <br />when detailed knowledge of the exact loads or service locations within <br />Tract 4788 in the District are made known to PGandE. <br /> <br /> 8. All of the Electric Facilities and part of the Street Lighting <br />Service Facilities to be installed within the District will be constructed <br />by PGandE. <br /> <br /> 9. The ownership of the Electric and Street Lighting Service <br />Facilities installed by PGandE shall vest in PGandE in accordance with pro- <br />visions of Sections 10109, lOllO and 10111 of the Streets and Highways Code <br />of the State of California. <br /> <br /> NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS: <br /> <br /> I. Electric Substructures and Electric and Street Lighting <br /> Service Facilities <br /> <br /> A. Prior to receipt by PGandE of applications to serve any <br />electric load, Developer shall furnish and install certain Electric Sub- <br />structures shown on Exhibit "A" in accordance with PGandE's Engineering <br />Standard No. 99, copy attached, and convey the Electric Substructures as <br />provided in Section II.F. hereunder, in advance of any construction work <br />by PGandE. The estimated value of such Electric Substructures, excluding <br />those substructures described in paragraph I.B. below, is $67,433. This <br />amount may be subject to refund as provided in the present electric exten- <br />sion rule and subject to the provisions of Section I.N. below. However, <br />refunds, if any, contemplated under this agreement will be subject to the <br />applicable rule in effect at the time of utilization, as provided in <br />Section I.K. of this agreement. <br /> <br />3: <br /> <br /> <br />
