CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 82-469 <br /> <br />RESOLUTION APPROVING CONNECTION OF THE PORTER <br />PROPERTY TO CITY SEWER AND WATER SYSTEMS WITH A <br />PREANNEXATION AGREEMENT <br /> <br />WHEREAS, <br /> <br />the property on which the proposed Quail Creek <br />affordable housing development is to be located is <br />encumbered by easements for the benefit of the <br />Frank Porter property, which is located at the <br />southeast corner of the proposed development; and <br /> <br />WHEREAS, the easements allow taking water, discharging <br /> water and road access; and <br /> <br />WHEREAS, <br /> <br />before development of the Quail Creek project can <br />continue, it is necessary to clear these easements; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Approves the connection of the Porter property <br /> to the city sewer and water systems provided that <br /> a preannexation agreement is executed by Dr. <br /> Porter, pursuant to the attached corresDondence <br /> dated November 22, 1982. <br /> <br />Section 2: Approves these utility connections provided <br /> staff include appropriate conditions of approval <br /> on the tentative map for the Quail Creek project <br /> to require the clearing of the Porter easements. <br /> <br />Section 3: Authorizes the Mayor to execute the Preannexation <br /> Agreement between the City of Pleasanton and Frank <br /> Porter. <br /> <br />Section 4: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED NOVEMBER 23, 1982 BY THE FOLLOWING VOTE: <br /> <br />AYES: Councilmembers Brandes, Mohr, and Wood <br />NOES: Councilmember Mercer and Mayor Butler <br />ABSENT: None <br />ABSTAIN: None <br /> <br /> TEST: <br /> <br /> George, Deputy City Clerk <br /> <br />APPROVED AS TO FORM: <br /> <br />Peter D.
