Frank Porter 2775 Vineyard Avenue Pleasantco, CA 94566 Dear Frank: As ~ou know, Quail Creek will be ac~alrlng the ~arcel of property adjoining your property located at 2779 Vineyard Avenue ("Parcel 11-5"). This letter of intent will serve to confirm c~ar L~clerstanding with respect to water rights, discharging of waste water through leach lines from your property, exchange of certain properties, costs, and fees° Pegarding the well located on Parcel 11-5 and your ~ater usage, you have agreed to abandon and grant beck to'Quail Creek, and its successors as owners of Parcel 11-5, your easement for the taZ<ing of water from Parcel 11-5. In exchange, Quail Creek agrees to drill p a ne~ water well cn .your property in a loc~tion satisfactory to you which will be similar in quality and quantity as the curremt well which you have agreed to abandon. We have further agreed that you will be free to remove frce Parcel 11-5 any pumps, pipes and similar equjl~eent connected with the present well at }~)ur expense, provided that any damage to Parcel 11-5 is repaired, that such removal does not interfere with work being done on Parcel 11-5, and that such re~oval is accomplished in ccmFliance with applicable laws. You have also agreed to abandon and grant beck to Quail Creek, and its successor~ as owners of Parcel 11-5, your easement for the discharge of waters omto Parcel 11-5. With respect to your cn going sewer drainage needs, Quail- Creek will use its best efforts to pers~de the City of Pleasanton.to allow you to hook 'up to the City Sewer system through the Quail Creek connection without the necessity of annexing your [zoperty to the City. This will probably require a pre-annexatlon agreement in resrect to your 'property. Quail Creek will pay all necessary costs and fees associated with installing a new sewer, sewer hook up fees imposed by the City or any other miscellaneous ccsts associated with a new sewer syste.~. Quail Creek also agrees to give you a perscnal license to continue to remove water from Parcel 11-5 in the present ma~aer until your new well is drilled or u~til February 1, 1983, whichever is sooner, and a lDersonal license to ccotinue to discharge water onto Parcol 11-5 in the present manner until alternative drainage facilities are available or February 1, 1983, whichever is sooner.
