AMENDMENT TO PLEASANTON/DUBLIN <br /> TRANSIT STUDY AGREEMENT <br /> FOR CONSULTANT SERVICES <br /> <br /> THIS AMENDMENT to the "PLEASANTON/DUBLIN TRANSIT STUDY <br />AGRE[MENT FOR CONSULTANT SERVICES" is made by and between the <br />CITY OF PLEASANTON, a municipal corDoration, (hereinaft~r <br /> <br />"City") and DKS ASSOCIATES, a California corporation, <br /> <br />"Consultant") on the day of December, 1983. <br /> <br /> RECITALS <br /> <br /> A. City and Consultant entered an agreement dated <br />Ju~e 9, 1983, the "Pleasanton/Dublin Transit Study Agreement <br /> <br />for Consultant Services" (hereafter the "Agreement"). Said <br /> <br />Agreement provided for payment based on a fixed fee. <br /> <br /> B. City and Consultant wish to modify the Agreement to <br />provide for payment based on a cost plus fixed fee basis with <br />a maximum fee limitation rather than the fixed fee method, <br />make certain other minor changes relating to payment. <br /> <br /> NOW, THEREFORE, the parties heret6 agree as follows: <br /> <br /> 1. The Agreement is hereby amended to delete Section 9 <br />in its entirety and replace it with a new Section 9 to read <br />as follows: <br /> <br />(hereinafter <br /> <br />and to <br /> <br />Payment. <br /> <br />The City shall pay Consultant for the work described <br />herein on a cost plus fixed fee basis, except, however, <br />the total payment to Consultant for work described <br />in Phase I shall not exceed Twenty Thousand Dollars <br />($20~000.00) and the total payment to Consultant for <br />work described in Phase II shall not exceed <br />Fifty-four Thousand Dollars ($54,000.00). <br /> <br />Work may begin as of June 20, 1983 on Phase II but <br />shall be reimbursed solely by non-federal funding <br />and shall not exceed Five Thousand Dollars ($5,000.00).' <br />All further work for the Phase II project shall not <br />begin until July 1, 1983. <br /> <br /> -1- <br /> <br /> <br />
