pursuant to the November 8, 1972 Settlement Agreement <br /> between the City, Valley Community Services District <br /> and District Users or any subsequent agreements or <br /> judicial interpretations giving the Developer legal <br /> rights as to that sewer capacity. <br /> <br />III. CONTRIBUTIONS <br /> <br /> A. Improvements <br /> <br /> City shall select either option 1 or option 2 by January 15, <br /> <br />1984. <br /> <br /> Option 1. <br /> <br /> (i) Developer will construct an eight-foot masonry <br /> sound wall (measured from the to~ of the street curb) along <br /> both the north side and the south side of Valley Avenue <br /> between Hopyard Road and Santa Rita Road, totalling <br /> approximately eight thousand one hundred and ninety <br /> <br /> (8,190) lineal feet, as shown on Exhibit B. The wall shall <br /> be adobe style with slumpstone finish on the right-of-way <br /> side and with skip trowel finish on the reverse side or <br /> equivalent approved by City Council. <br /> <br /> (ii) Developer will construct a six-foot wide <br /> meandering concrete sidewalk along the north side of <br /> Valley Avenue between Hopyard Road and Santa Rita Road, <br /> totalling approximately four ~housand five hundred and <br /> ninety (4,590) lineal feet, as shown on Exhibit B. <br /> <br /> (iii) Developer shall install low maintenance <br /> landscaping complete with sprinkler systems as needed <br /> in the right-of-way not including the median islands on <br /> <br />-5- <br /> <br /> <br />
