City seeks to reach final ~Lndersl:aL'~di~ concerning <br /> <br />certain .fences, gates, and sucll devices veq,,~,:ed in Paragraph <br />8 of che February 131 1979 agreement in order ro satisfy <br />Property Owner and ensure City co~npliance with the terms of <br /> <br />that agreement. <br /> <br /> ~OW, THEP~FORE, the <br /> 1. Right-of-Entry: <br /> <br />parties hereto a~ree as follows: <br />Area #__1. Property Ownershereby <br /> <br />authorizes City, or its designated representatives, to enter upon <br />the property shown on the attac~ed Exhibit "B" as "Area ~1" <br /> <br />(and as described in Exhibit B-l) to construct a water reservoir. <br />It'is the understanding of the parties that Property Owner <br /> <br />and City shall diligently pursue, <br />of Area #1 from Property O~ner to <br /> <br /> 2. R__ight-of-Entry: Area #2. <br /> <br />in good faith, the sale <br />City. <br /> <br /> Property Owner hereby <br /> <br />authorizes City, or its designated representatives, to enter <br />upon the property shown generally on the attached Exhibit B <br />as "Area #2" for temporary construction purposes, including, <br />but not limited to, a stockpile of excavated material, storage <br />of construction equipment, and construction of the roadway <br />and reservoir. <br /> <br /> 3. Return of Area #2 to {)~'igi~Lai Condition. Promptly <br />following the completion of construction, City shall return <br />all thope areas utilized for stockpile purposes, construction <br />storage areas, and other such temporary uses to, generally, <br />the grade and condition existing as of the date of this agreement. <br /> <br />-2- <br /> <br /> <br />
