RIGHT-OF-ENTR~ AGREEMENT <br /> <br />DRAFT 2 <br /> <br /> THiS AGREEMENT is made and entered into this day of <br /> <br />October, 1983, byand between [hROLD H. ~OLI,ER and LLOYD M. <br />HOLLER (hereafter "Property O~mer") and the CITY OF PLEASANTON, <br />a municipal corporation, (hereafter "City"). , <br /> <br /> RECITALS <br /> <br /> 1. Harold H. Moller, Evelyn B. Moller, Lloyd M. Moller and <br />Roy J. Moller and City entered into an agreement dated <br /> <br />February 13, 1979 (Exhibit "A") pursuant to which City purchased <br />certain property to construct a water reservoir and an easement <br />for roadway purposes to reach the reservoir site. <br /> <br /> 2. C~ty now desires ~o cc,n!;truct a larger reservoir on <br />the site than originally planned and desires to acquire additional <br />property in order to accommodate the larger reservoir. <br /> <br />3. City further desires to begin construction on the <br />access roadway and reservoir as soon as possible in order to <br /> <br />complete enough site improvements to enable <br />proceed through the winter. <br /> <br /> 4. Because the property 5c~ht to be <br /> <br />construction to <br /> <br />acquired by City <br /> <br />is subject to certain nrobaCe proceedings, City cannot expeditiously <br />acquire the additional property necesss. ry, and, accordingly, City <br />seeks a right-of-entry to enable construction to begin nrior <br /> <br />to the resolution of probate <br />of the hcquisition. <br /> <br />proceedings and .final resolution <br /> <br /> <br />
