that there are changes in circumstances which <br />make the condition of the 40 foot building <br />setback no longer appropriate or necessary; <br /> <br />that the modifications do not impose any <br />additional burden on the present fee owner of <br />the property; <br /> <br />the modifications do not alter any right, <br />title, or interest in the real property <br />reflected on the recorded map; and <br /> <br />finds that the map as modified conforms to <br />the provisions of Section 66474, i.e. is <br />consistent with the City of Pleasanton General <br />Plan; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> Authorizes the City Engineer to execute and <br />record the appropriate certificates of correction, <br />approved by the City Attorney, reducing the building <br />setback line from 40 feet to 10 feet on affected <br />properties as indicated on Tract 4373, Parcel Map <br />3529 and Parcel Map 2293. <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED OCTOBER 11, 1983 BY THE FOLLOWING <br />VOTE: <br /> <br />AYES: <br /> <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />ATTEST: <br /> <br />Councilmembers - Brandes, Mercer, Mohr, Wood and <br />Mayor Butler <br />None <br />None <br />None <br /> ROBE ~ ~~"~ <br /> ~E.
