WHEREAS, <br /> <br />WHEREAS, <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. 83-449 <br /> <br />RESOLUTION APPROVING MODIFICATION TO CONDITION OF <br />APPROVAL OF TRACT 4373, PARCEL MAP 3529 AND PARCEL <br />MAP 2293 REDUCING BUILDING SETBACK FROM 40 FEET TO <br />10 FEET <br /> <br />Council approved Parcel Map 2293 with certain <br />conditions attached, one of which required a 40 <br />foot building setback line contiguous to the top <br />of the bank of the Arroyo de la Laguna west bank; <br />and <br /> <br />this setback was perpetuated on two subsequent <br />maps, Parcel Map 3529 and Tract Map 4373; and <br /> <br />since the imposition of this condition, circumstances <br />have changed and it is no longer necessary to <br />require a 40 foot setback for the following reasons: <br /> <br />the likelihood of widening the Arroyo de la <br />Laguna to the west is no longer a possibility <br />in light of recent Corps of Engineers, Zone 7 <br />and private engineering firm studies which <br />indicate that future widening will be to the <br />east; <br /> <br />with the creation of Tract 4373, all of the <br />homes will be connected to public sewer <br />systems thus eliminating the need for septic <br />tanks; and <br /> <br />by retaining the 10 foot setback width, any <br />building will not be able to be located at <br />the top of the bank preventing an undesirable <br />situation; and <br /> <br />the present owners of the areas affected by this <br />requirement have requested that this 40 foot <br />building setback line be reduced to 10 feet from <br />the recreation easement; and <br /> <br />in his report dated October 6, <br />of Public Works and Utilities <br />with the request; and <br /> <br />1983, the Director <br />indicated his concurrence <br /> <br /> ~EREAS, after a review of the report and public testimony, <br />- Council makes the following findings: <br /> <br /> <br />
