oversized water mains, or any other water facilities which <br />are both in excess of the capacity required for the project <br />site alone and create a reduction in the cost of the new water <br />facilities necessary for the North Pleasanton area, the Owner <br />will be credited for such reduction and/or, if permissible under <br />the financing mechanism selected by the City, directly reimbursed <br />therefor. <br /> <br />III. FIRE SERVICE REQUIREMENTS <br /> <br /> Owner agrees to participate in the financing of the fire <br />apparatus, manpower and other fire safety facilities required <br />to serve the project or made necessary due to the cumulative <br />development of major commercial/industrial projects. Fire <br />apparatus, manpower and other facilities necessary shall be <br />those identified as required to maintain existing levels of <br />fire service in the above-mentioned study and as deemed <br />necessary by the City. Owner agrees to participate in the <br />funding of such apparatus, manpower and other facilities in <br />whichever manner best achieves the maintenance of existing <br />levels of fire service through timely additions of fire safety <br />equipment, facilities and personnel, as determined by City. In <br />determining the level of participation of such funding agreed to <br />herein, City shall take into consideration the project's <br />contribution towards fire services in its ordinary contribution <br />toward funding city services, generally (via taxes, etc.) and <br />the level of fire protection designed into the project. <br /> <br />IV. ENFORCEMENT OF PUD CONDITIONS <br /> <br /> Owner agrees that the conditions of PUD-81-22 are a <br /> <br />benefit to the project site as reasonable regulations designed <br /> <br /> -4- <br /> <br /> <br />
