caused by, created by or in any way connected with the <br />Lessee's use of the subject building. It is furthr agreed <br />that Lessee will name the City, members of the City Council, <br />their agents, servants and employees as additional insureds <br />with respect to liability resulting from the use of said <br />facilities by Lessee and the conduct of Lessee's activities <br />at City's facilities. Lessee agrees to deliver to City upon <br /> <br />execution of this agreement, a Certificate <br />satisfactory in form to the City Attorney, <br />Lessee has obtained a continuing policy of <br /> <br />of Insurance, <br />showing that <br />insurance indemnifying <br /> <br />and holding harmless City against any and all claims, in the <br />amount of $500,000 for injury to any one person and $100,000 <br />for property damage, providing for ten (10) days notice to <br />City prior to cancellation and shall keep same in force <br />during the term of this agreement. Lessee is not obligated <br />to provide fire insurance for the structure. <br /> <br /> 8. Termination by Lessor. Lessor may terminate this <br />lease at any time it should be determined by the City Council <br />that the public necessity and convenience require it to do <br />so, by serving upon Lessee a written notice of its election <br />so to terminate, which said notice shall be served at least <br />sixty (60) days prior to the date named in such notice for <br />such termination. Lessor may terminate the lease immediately <br />if the premises are damaged to such a degree that in the <br />opinion of the City Manager, continued use is not safe or <br />feasible. If the Lessor terminates the lease during the <br />five year lease, Lessor shall reimburse Lessee on a prorata <br /> <br />-3- <br /> <br /> <br />
