III. <br /> <br />City's <br /> <br /> 2. One a building permit is issued, its time of <br />expiration shall be controlled by Uniform Building Code <br />Standards. In that event, any fees or consideration <br />paid pursuant to this agreement shall not be refundable. <br /> <br /> 3o Upon expiration of the growth management <br />approval or building permit issued pursuant to the <br />growth management approval, the approval shall be <br />terminated as to the developer and the City will reallocate <br />those units in accordance with the growth management plan. <br /> <br /> 4. The expiration of growth management' approvai <br /> <br />as to a unit or units authorized for a specific year <br />shall not be considered a breach of this agreement by <br />the Developer and shall in no way affect the validity <br />of a growth management approval for subsequent years. <br /> <br /> 5o Expiration of growth management approval or <br />building permit issued pursuant to the growth management <br />approval as to a unit or units will, unless otherwise <br />provided by action of the City, terminate the obligation <br />of the City to the Developer as to said unit or units <br />pursuant to the November 8, 1972 Settlement Agreement <br />between the City, Valley Community Services District <br />and District Users or any subsequent agreements or <br /> <br /> judicial interpretations giving the developer <br /> rights as to that sewer capacity. <br /> CONTRIBUTIONS <br /> <br />A. <br /> <br />legal <br /> <br /> Growth Management Fee <br /> <br /> Developer will contribute $525 per unit to the <br />Capital Improvement Fund and $400 per unit to the <br /> <br /> <br />
