Owner may apply for necessary <br /> <br /> division approvals in advance of the year <br /> <br />management approval has been given. <br /> <br />B. Building Permits <br /> <br /> 1. Building permits may be obtained <br /> <br />year for which growth management approval is <br />in the next two calendar' years. Thus where <br />identifies a growth management approval for the year' 1984, <br />building permits for the authorized units must be obtained <br />December 31, 1986. <br /> <br /> 2. Once a building permit is issued, its time of <br />expiration shall be controlled by Uniform Building Code <br />Standards. In that event, any fees or consideration paid <br />pursuant to this agreement shall not be refundable. <br /> <br /> 3. Upon expiration of the growth management approval <br /> <br />or building permit issued pursuant to the growth management <br />approval, the approval shall be terminated as to the Owner <br />and the City will reallocate those units in accordance with <br />the growth management plan. <br /> <br /> 4. The expiration of growth management approval as <br />a unit or units authorized for a specific year shall not be <br />considered a breach of this agreement by the Owner and shall <br />in no way affect the validity of a growth mangement approval <br />for subsequent years. <br /> <br /> 5. Expiration of growth management approval or <br /> <br />a building permit issued pursuant to the growth management <br />app'roval as to a unit or units will, unless otherwise <br /> <br />to <br /> <br />by <br /> <br />-5- <br /> <br /> <br />
