prior to the completion of the DSRSD-LAVWMA Expansions <br />unless, in accordance with City's then existing rules <br />and regulations, uncommitted capacity is available at <br />the time Prudential properly applies for it. <br /> <br /> (b) Reservation of Capacity in the DSRSD- <br />LAVWMA Expansions. Upon completion of the DSRSD-LAVWMA <br />Expansions, City shall reserve sewage capacity ("Exist- <br />ing Prudential Capacity") in the amount of Three Hundred <br />Thousand (300,000) gallons average day dry weather flow <br />("Existing Prudential Capacity") (measured pursuant to <br />City's Sewerage Code as One Thousand Three Hundred <br />Sixty-Three and Sixty-Four Hundredths (1,363.64) Resi- <br />dential Discharge Equivalents) for use on the Prudential <br />Property. The Existing Prudential Capacity shall be <br />utilized for the Prudential Property which shall include <br />all property owned by Prudential within Parcel Map 3858 <br />and all subsequent phases of the Hacienda Business <br /> <br />Park. The Existing Prudential Capacity shall be reduced <br />by the sewage capacity utilized by Prudential, prior to <br />completion of the DSRSD-LAVWMA Expansions, pursuant to <br />Section 8(a). Except as provided in this Section 8, no <br />sewage capacity other than that reserved in this Sec- <br />tion (b) or other capacity acquired from governmental <br />authorities shall be utilized for the Prudential Prop- <br />erty unti~ the reservation has been exhausted.
