owner of Fromm Business Park at the time the DSRSD- <br /> LAVWMA Expansions Capacity is available. <br /> <br /> (d) Reimbursement to Prudential. Except as <br /> provided in Section 7(c)(iii), City shall pay to Pruden- <br /> tial ninety percent (90%) of the Stage 3A Sewer Expan- <br /> sion Surcharge within ten (10) days after receipt by <br /> City. City shall retain the remaining ten percent (10%) <br /> of the Stage 3A Sewer Expansion Surcharge as an adminis- <br /> trative charge. <br /> <br /> 8. Allocation of Sewer Connections to Prudential <br />Property. The Prudential Property shall receive sewer con- <br />nections from City in accordance with the provisions of this <br />Section. <br /> <br /> (a) Availability Prior to Completion of <br /> DSRSD-LAVWMA Expansions. Pursuant to the terms of the <br /> Amended Agreement and prior to completion of the DSRSD- <br /> LAVWMA Expansions, Prudential and CPP have been issued <br /> sewer connections in connection with applications for <br /> building permits. Until completion of the DSRSD-LAVWMA <br /> Expansions, Prudential may seek sewer connections for <br /> the Prudential Property which, in aggregate, shall not <br /> exceed One Hundred Thousand (100,000) gallons of capa- <br /> city (measured pursuant to City's Sewerage Code as Four <br /> Hundred Fifty-Four and Fifty-Five Hundredths (454.54) <br /> Residential Discharge Equivalents).
