NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: Upholds the decision of the Planning Commission <br /> approvin~ the application of Chris Beratlis for a <br /> conditional use Dermit to operate a 940 sq. ft. <br /> "take-out" restaurant at 929-B Main Street, subject <br /> to all the conditions of the Planning Co~nnission <br /> exceDt condition number 2, which shall be deleted. <br /> Conditions of aDproval shall be: <br /> <br />That this use permit is Branted for the 940 <br />sq. ft. building known as 929-B Main Street <br />only. <br /> <br />That the operator of the restaurant shall use <br />his best efforts to insure that his customers <br />do not consume food sold on the premises <br />immediately outside of the building and that <br />customers do not loiter in front of or around <br />the place of business. <br /> <br />That no more than ten seats shall be installed <br />in the restaurant unless additional parking <br />is made available for the use. <br /> <br />That the owner of the restaurant shall maintain <br />the premises including the sidewalk to the <br />front of the building in a neat and orderly <br />fashion at all times. <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED AUGUST 9, 1983 BY THE FOLLOWING <br />VOTE: <br /> <br /> AYES: Councilmembers Brandes, Mohr, Wood and ~ayor Butler <br /> NOES: None <br /> ABSENT: Councilmember Mercer <br /> ABSTAIN: None <br /> <br /> TEST: <br />Ci~yC~~E/" BUTLER, MAYOR <br /> By Doris George, Deputy City Clerk <br /> <br />APPROVED AS TO FORM: <br />Attorney <br /> <br />-2- <br /> <br /> <br />
