WHEREAS, WHEREAS, WHEREAS , WHEREAS, WHEREAS, WIIEREAS, CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. 83-344 RESOLUTION APPROVING THE APPLICATION OF CHRIS BERATLIS FOR A CONDITIONAL USE PERMIT TO OPEP~TE A 940 SQo FT. "TAKE-OUT" RESTAURANT AT 929 "B" MAIN STREET at its meeting of July 13, 1983, the Planning Commission approved case UP-83-16, which granted a conditional use permit to oPerate a 940 sq. ft. "take-out" restaurant at 92~ "B" Hain Street; and within the time specified by the Ordinance Code, the City Council appealed the decision in order to review the application; and at its meeting of August 9, 1983, the City Council reviewed a report dated August 1, 1983 from the Director of Planning and Community Development together with the Minutes of the Planning Commission; and the City Council held a public hearing at which time members of the public were offered an opportunity to present evidence regarding this appeal; and the applicant urged the City Council to eliminate Condition No. 2 of the Planning Commission relating to review of the application; and after a review of the material presented, the City Council makes the following findings: That the proposed location of the conditional use is in accord with the objectives of this chapter and the purposes of the district in which the site is located. That the proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety or welfare or be materially injurious to properties or improvements in the vicinity. That the proposed conditional use will comply with each of the applicable provisions of Article 25, Chapter 2, of Title II of the Ordinance Code of the City of Pleasanton. -1-
