PGandE, pursuant to the Existing Agreement, agreed to complete the installation of that portion of the Electric Facilities to the extent necessary to provide electric service when detailed knowledge of ~he exact loads or service locations within the Development were made known to PGandE. The Developer paid $54,822 as an Electric Advance for the installation of Electric Facilities initially lnbca~/ed ~. 4. Developer, pursuant to Section I~H. of the Existing Agreement, agreed that prior to establishment of service to 'two or more bona fide enberprises with certain revei3ue-producing electric equipment, PGandE would, at Developer's expense, complete additional portions of the Electric Facilities and Electric Substructures that may be required and under the same conditions of the Existing Agreement. 5. Developer has requested PGandE to amend and modify the Existing Agreement to provide for the establishment of an equivalent one-time cost of ownership fund in lieu of continuing additional monthly payments for special street lighting equipment furnished by PGandE (Supplemental Agreement). NOW, THEREFORE, IT IS NDTIJALLY AGREED AS FOLLOWS: 1.
