DRAFT <br />AGREEMENT IMPLEMENTING SECTION 3 <br />OF THE APRIL 5, ].983 AGREEMENT <br /> <br /> THIS AGREEMENT made and entered into this day of <br /> <br /> , 1983, by and between the CITY OF PLEASANTON, <br /> <br />a municipal corporation (hereinafter referred to as "City"), <br />and DUBLIN SAN RAMON SERVICES DISTRICT, a public a%ency (herein- <br />after referred to as "District"). <br /> <br /> RECITALS <br /> <br /> A. The November 8, 1972 agreement between the subject <br />parties provided guidelines for allotting sewer capacity to <br />residential connections (at paragraph 6); and <br /> <br /> B. The May 30, 1978 agreement between the subject <br />parties adopted the 1972 guidelines as part of the definition <br />of "Permissible Flow" on page 5 of that agreement; and <br /> <br /> C. The April 5, 1983 agreement between the subject <br />parties (Exhibit "A") amended the May 30, 1978 agreement by <br />amending the definition of "Permissible Flow", added the <br />definition of "Committed Flow" and, in Section 3 thereof, <br />provided for maintenance of five percent (5%) reserve capacity <br />by both agencies until appropriate water conservation measures <br />and engineering studies were undertaken. <br /> <br /> AGREEMENT <br /> <br />NOW, <br />1. <br />conservaEion measures in accordance with <br />April 5, 1983 Agreement. <br /> <br />THEREFORE, the parties hereto a%ree as follows: <br /> <br />The District and the City have each undertaken water <br /> <br /> Section 3 of the <br /> <br />-1- <br /> <br /> <br />
