McKee, Inc., dated November 9, 1982. The City was reimbursed <br />by Prudential for the cost of the preliminary design pursuant to <br />an agreement, dated December 6, 1982. <br /> <br /> E. On July 12, 1983, the City authorized a contract for <br />Phases II and III (final design and construction services <br />for the proposed Foothill Reservoir) with Camp, Dresser & <br />McKee, Inc. <br /> <br /> F. Prudential is aware that environmental assessment and <br />adoption of mitigation measures as appropriate will be required <br />by the City prior to commencement of construction (including <br />site preparation) Of Foothill Reservoir or Tassajara Reservoir. <br /> <br /> G. The parties contemplate that either an addendum to <br />this Agreement or a separate 'agreement shall be necessary <br />prior to Prudential's advancing money for construction Of the <br />Foothill Reservoir water tank, if that becomes necessary prior <br />to formation of the assessment district. <br /> <br /> THE PARTIES HEREBY AGREE AS FOLLOWS: <br /> <br /> 1. 'Items of Work. Subject to the terms of Section 2, <br />Prudential agrees to reimburse City for the following items <br />of work:' <br /> <br /> (a) Final design of Foothill Reservoir (Phase II) <br /> <br />as set forth in the Julyl2, 1983 agreement between Camp, <br />Dresser & McKee, Inc. and the City, with the cost of the final <br />design, as set forth in the July 12, 1983 agreement, being <br />Ninety Thousand Dollars ($90,000.00). <br /> <br /> (b) Right-of-way and additional site acquisition <br /> costs for Foothill Reservoir, with such costs estimated to be <br /> <br />7 <br /> <br /> <br />
