JUL 2 5 1983 <br /> <br />AGREEMENT <br /> <br /> THIS AGREEMENT is made and entered into this day <br /> <br />of , 1983, by and between THE PRUDENTIAL INSURANCE <br /> <br />COMPANY OF AMERICA, a New Jersey corporation (hereinafter <br />referred to as "Prudential"), and THE CITY OF PLEASANTON, a <br />municipal corporation (hereinafter referred to as "City"). <br /> <br /> RECITALS <br /> <br /> A. There is significant proposed and approved industrial/ <br />co.m, ercial growth in North Pleasanton. In order for such <br />growth to have adequate water, there must be improvements to <br />the City's water system, including the addition of an eight · <br />million (8,000,000) gallon reservoir in the vicinity of <br />Foothill Road (~"Foothill Reservoir"). <br /> <br /> B. The parties contemplate that Foothill Reservoir, <br /> <br />the proposed Tassajara Reservoir and related water system <br />improvements will be included in an assessment district ("North <br />Pleasanton Water Improvement District") to be formed in <br />approximately early 1984. <br /> <br /> C, Prudential is the owner of lands within the area to <br />be served by the proposed Foothill Reservoir. Prudential has <br />volunteered to provide funding in advance of the formation of <br />the North Pleasanton Water Improvement District to accelerate <br />the construction of the Foothill Reservoir in order that <br />development of its proposed project can proceed expeditiously <br />subject to Prudential obtaining necessary governmental approvals. <br /> <br /> D. The preliminary design of Foothill Reservoir was <br />completed by contract between the City and Camp, Dresser & <br /> <br /> <br />
