( <br /> <br />BXHIBFF "A" <br /> <br />unless sueli liability, cost and expense is caused solely by the active negligence of <br />Railroad, its employees, or agents. <br /> <br />The term "Railroad," as used in this section, shall include the successors, assigns~ and <br />affiliated companies of Railroad and any other railroad company operating upon <br />Railroad's tracks. <br /> <br />Upon the expiration or terminsStion of the lease, Assignee shall remove from and off <br />tlie premises all property owned or controlled by Assignee and restore the premises <br />to a condition satisfactory to Railroad; and upon failure so to do, Railroad may perforn{ <br />such work at Assignee's expense. Until said property is removed and premises restored, <br />either by Assignee or by Railroad at . Assignee's expense, the lease, with all terms <br />contained therein, as herein modified, including the payment of rental, shall, at Railroad's <br />option, remain in full force and effect until said property is removed and pre~mises <br />restored. <br /> <br />Section 2 of the lease .relating to-the original term thereof and the right of either <br />party hereto to terminate on thirty {30) days' notice is hereby deleted therefrom- <br /> <br />Notwithstanding anything to the contrary otherwise provided in the assigned lease, as <br />hereby modified, Railroad agrees, upon receipt of written notice from Assignee delivered <br />not later than thirty (30) days prior to the expiration of the term of the lease, as <br />hereby extended, to enter into negotiations with Assignee for a further extension of <br />the lease or other arrangements regarding the use of the leased premises for~ <br />beautification purposes. Should the parties be unable to mutally agree upon new terms <br />and conditions satisfactory to each other prior to such expiration, the term of the <br />assigned lease shall then expire in accordance with the provisions contained herein. <br /> <br /> <br />
