F, XHIBIT "An <br /> <br />The lease herein assigned is hereby revised to include the following provisions: <br /> <br />Subject to all of the terms, covenants end conditions of the lease, as herein modified, <br />the term thereof is hereby extended for a period of ten (10) years commencing as of <br />the effective date ef this assignment. <br /> <br />In case Assignee holds over the term of the lease, as herein extended, such holding <br />over shah be deemed a tenancy only from month to month, but shall be subject to <br />the sames terms and conditions as herein provided, and to Railroad's right to revise <br />the rental then in effect at any time during such holdover period. -- <br /> <br />For said 10-year term, Assignee shah pay to Railroad i~s rental for the leased premises <br />tile sum of ONE HUNDRED DOLLARS ($100) per month, payable monthly in advance. <br /> <br />Assignee shaH, at its expense, comply with all applicable laws, regulations, rules imd <br />orders, regardless of when they become or became effective, including, without <br />limitation, those relating .to health, safety, noise, environmental protection, waste <br />disposal, and water and air quality, and furnish satisfactory evidence of such compliance <br />upon request of Railroad. <br /> <br />Should any discharge, leakgge, spillage, emission, or pollution of any type occur upon <br />or from the leased premises due to Assignee's use and occupancy thereof, Assignee, <br />at its expense, shah be obligated to clean the premises to the satisfaction of Railroad <br />and any governmental body having jurisdiction thereover.. <br /> <br />Except as herein otherwise provided, Assignee, to the extent permitted by law, agrees <br />to indemnify,. hold harmless and defend Railroad against all liability, cost and expense <br />(including, without limitation, any fines, penalties, judgments, litigation costs and <br />attorneys' fees) incurred by Railroad as a result of Asslgnee's breach of this Section <br />3, or as a result of any such discharge, leakage, spillage, emission or pollution, regardless <br />of whether such liability, cost or expense arises during or after the lease term, as <br />herein extended, unless such liability, cost or expense is proximately caused solely by <br />the active negligence of Railroad. <br /> <br />Assignee shall pay all amounts due Railroad under this Section 3, as additional rent, <br />within ten (10) days after any such amounts become due. <br /> <br />Section 7 of the lease relating to indemnification is hereby deleted therefrom and <br />Section 5 hereof substituted therefor. <br /> <br />To the extent permitted by law, Assignee shall release and indemnify Railroad from <br />and against all liabil-ity, cost, and expense for lo~ of or damage to property, and for <br />injury to or death of any person (including, but not limited to, the property and <br />employees of each party hereto) when arising or resulting from: <br /> <br />(a) the use of tile premises by Assignee, its agents, <br /> employees, invitees, or licensees, or <br /> <br />(b) <br /> <br />breach by Assignee of tile provisions of the lease, as <br />amended, <br /> <br /> <br />
