that the granting of the variance will not be <br />detrimental to the public health, safety, or <br />welfare, or materially injurious to properties <br />or improvements in the vicinity; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1: <br /> <br /> Approves the appeal of Ralph and Pearl Goold (AP-83-8) <br />of a decision of the Board of Adjustment denying <br />their application for a variance to allow the <br />construction of an accessory building which would <br />encroach into the required side yard of the property <br />located at 3651 Zwissig Court, thereby approving <br />the aforementioned construction, subject to the <br />following conditions: <br /> <br />that the design of the accessory structure <br />shall match the residence both in color and <br />architectural style; <br /> <br />that the accessory structure shall be set <br />back from the front of the house at least <br />eight feet; and <br /> <br />3. that this variance is granted to Mr. Goold as <br /> the owner of the property and does not run <br /> with the land. <br /> <br />Section 2: This resolution shall become effective immediately <br /> upon its passage and adoption. <br /> <br />THIS RESOLUTION ADOPTED JUNE 28, 1983 BY THE FOLLOWING VOTE: <br /> <br />AYES: <br /> <br />Councilmembers - <br />Mercer <br />None <br />Mayor Butler <br />None <br /> <br />Brandes, Mohr, Wood and Vice Mayor <br /> <br />NOES: ~{ERCER,~R <br />ABSENT: <br />ABSTAIN: <br /> <br />ATTEST: <br /> <br />By Doris George, Deputy City Clerk <br /> <br />A ROVED AS TO FORM: <br /> <br />Peter D.
